Mr Funny aka Sabinus Threatens Suit On Friesland and UAC Foods For Trademark Infringement

Chukwuemeka Emmanuel Ejekwu better known as Mr Funny and Oga Sabinus has threatened to sue beverage manufacturing powerhouses Friesland and UAC Foods for unauthorized use of his trademarked phrase and image to promote their products.

The Instagram sensation via his lawyer Stanley Alieke issued a pre-suit notice to the stated companies demanding N1 billion from Friesland who are the makers of Peak milk, and an additional N100 million from UAC foods the makers of the popular Gala sausage roll.

His lead counsel in his statement stated that his client, Ejekwu had trademarked his slogan ‘something hooge’ which Friesland foods had used to promote its Peak Milk product on social media. He revealed that the phrase was trademarked on the 26th of November 2021 with the file number: NG/TM/O/2021/48316. 10.

The peak milk advert featured the phrase “Something hooge is coming,” on the other hand, the Gala advert featured a cartooned image of Sabinu’s most popular image with the caption “Me Calculating how man Gala I need to survive all my meetings today.”

His counsel’s address dated the 27th of May, 2022 reads;

“Our client briefed us and we believe the same to be true that your company, Friesland Foods Wamco Nigeria Plc, used a trademarked slogan ‘Something Hooge’ for the promotion of your Peak Milk product.

The advert which was made on the Peak Milk Nigeria verified Instagram page (peak_milk) was posted on the 24th day of May 2022 which was used to promote the Peak National Breakfast Week.

It will interest you to know that the phrase ‘something hooge’, which was popularised by our client, has been trademarked and legally reserved as his intellectual property by the Federal Ministry of Trade and Investment.

The said slogan was trademarked on the 26th of November 2021 with the file number: NG/TM/O/2021/48316. 10. On this note, we make the demand for the payment of the sum of Five Hundred Million Naira (N500m) as compensation for the unauthorized use of the intellectual property belonging to our client.

And another five hundred million Naira for damages for the trauma; emotional, physical, psychological, and mental trauma our client has suffered for the Trademark theft and infringement of his intellectual property rights.”

 

Sabinus

A separate notice addressing UAC’s infringement and dated 25th of May 2022 reads;

“Your company UAC Food Ltd. has been using the brand picture and other intellectual properties of Sabinus to make adverts for your Gala sausage roll without the consent or authorization of our clients.

You made a post on your verified Instagram handle (gala sausage roll), on the 23rd of May, 2022 with the picture of our client. The post which was a cartoon of our client was captioned ‘the way I calculate everything in my life’.

“We demand that you pay our client the sum of one hundred million Naira (N100m) for the use of the picture which is the average fee our client charges for his picture to be used for adverts and promotions.”

Sabinus is enjoying a much-deserved moment in the sun thanks to his comic abilities which have been deemed original and refreshing by many Nigerians. He recently received the AMVCA Award for Best Online Social Content Creator.

Nollywood actor Daniel Etim-Effiong has opened up about his past as a womaniser, admitting that while it was a short-lived phase in his life, it was a significant learning experience, one he now warns young men against repeating.

In a recent interview with media personality Chude Jideonwo, the movie star admitted to dating multiple women simultaneously in his younger years.

Maybe there was a time in my life I was a womaniser. Definitions would differ, but in that definition, maybe there was a period in my life that I was, I wouldn’t say for long periods of my life. Maybe for certain periods that I explored. So, perhaps.

He described those moments as “periods of learning”. Still, he emphasised that such a lifestyle can lead to long-term consequences, especially for those looking to build stable relationships or marriages later in life.

He urged young people to avoid developing habits they wouldn’t want to carry into marriage, warning that commitment is a muscle that must be built.

I tell young people a lot that it is cool to be a player but if you develop that habit or lifestyle, you won’t automatically change overnight. So, don’t develop something you don’t want to continue for the rest of your life. If you are not able to commit to one person, if you jump from one relationship to another, that won’t automatically change when you marry.

When you marry that muscle hasn’t been developed so you encounter one challenge and you want to immediately jump or you just be like, ‘I’m talking to you; you are not listening to me, let me find somebody that would listen to me.

If you are the kind of person who, before you got married, it was easy for you to just walk away, keep different relationships, keep ladies on the string, that won’t change when you get married.
